These terms apply to property agents and other property professionals participating in the BRIXSO service. By submitting an application to become a BRIXSO agent and accepting these terms, you agree to comply with the requirements below when receiving or using buyer information provided through BRIXSO.

1. Purpose of BRIXSO buyer information

BRIXSO may introduce property seekers to agents whose geographical coverage, property expertise or available services appear relevant to the buyer's requirements. Information provided by BRIXSO is supplied for the purpose of enabling the agent to assess and respond to the relevant property enquiry and, where appropriate, assist the buyer with their property search.

2. Use of buyer information

You agree to use information received through BRIXSO only for legitimate purposes connected with the relevant property enquiry and related property services. You must not:

  • sell BRIXSO buyer information;
  • rent or commercially resell BRIXSO buyer information;
  • pass BRIXSO buyer information to unrelated third parties;
  • add BRIXSO buyer information to unrelated marketing databases without an appropriate lawful basis;
  • use BRIXSO buyer information for purposes unrelated to the relevant property enquiry; or
  • knowingly use BRIXSO buyer information in a way that would breach applicable data protection law.

If you wish to use buyer information for additional marketing purposes, you are responsible for ensuring that you have an appropriate lawful basis and comply with all applicable data protection and electronic marketing requirements.

3. Data minimisation

You must only use the buyer information that is reasonably necessary for the relevant property enquiry. You should not request or retain additional personal information where it is not necessary for the service you are providing.

4. Security

You must take appropriate steps to keep BRIXSO buyer information secure. This includes taking reasonable measures to prevent: unauthorised access; accidental disclosure; loss; alteration; misuse; and unauthorised copying or sharing. BRIXSO buyer information should only be accessible to people within your organisation who reasonably need it for the relevant property enquiry.

5. Retention and deletion

BRIXSO's standard retention period for buyer search information is 60 days. You agree to securely delete or anonymise BRIXSO buyer information received through the BRIXSO service after 60 days, unless you have a lawful reason to retain specific information for longer.

Examples of circumstances where longer retention may be appropriate include:

  • an ongoing transaction or enquiry;
  • a legal or regulatory obligation;
  • the establishment, exercise or defence of legal claims; or
  • another lawful basis for continued processing.

Where you retain information beyond 60 days, you remain responsible for ensuring that the continued processing and retention are lawful and appropriate. The 60-day requirement applies specifically to information received from BRIXSO for the purpose of the BRIXSO enquiry. It does not prevent you from retaining information that you are independently entitled or required to retain following a direct relationship or transaction with the buyer, provided that you have a lawful basis for doing so and comply with your own privacy obligations.

6. Sharing with third parties

You must not sell or pass BRIXSO buyer information to unrelated third parties. If it is necessary to share information with another organisation as part of providing property-related services to the buyer, you are responsible for ensuring that the sharing is lawful and that the appropriate privacy and data protection requirements are met.

7. Direct contact with buyers

Where BRIXSO provides contact details so that you can respond to a property enquiry, you may contact the buyer in relation to that enquiry. You must ensure that any subsequent direct marketing or other communications comply with applicable data protection and electronic marketing laws. A BRIXSO introduction does not automatically provide consent for unrelated marketing.

8. Accuracy

You should take reasonable steps to ensure that information used from a BRIXSO buyer brief is handled accurately. If a buyer tells you that information is incorrect or asks for it to be updated or deleted, you should deal with the request appropriately and, where relevant, notify BRIXSO.

9. Data protection rights

BRIXSO may receive requests from buyers relating to their personal information. Where BRIXSO contacts you because information you received through BRIXSO is relevant to such a request, you agree to provide reasonable assistance and information where appropriate. You remain responsible for dealing with data protection requests relating to your own independent processing of the buyer's information.

10. Personal data breaches

If you become aware of a personal data breach involving information received through BRIXSO, you must notify BRIXSO as soon as reasonably practicable at hello@brixso.co.uk. Your notification should provide sufficient information for BRIXSO to understand what happened and what information may have been affected. You must also comply with your own legal obligations relating to the breach.

11. Confidentiality

You must treat information received through BRIXSO as confidential and must take reasonable steps to prevent it being disclosed to people who do not need access to it.

12. Your data protection responsibilities

By participating in BRIXSO, you acknowledge that you are responsible for complying with applicable data protection legislation in relation to your own processing of personal information. Nothing in these terms removes or replaces your own legal responsibilities. You should maintain your own privacy notice and data protection procedures appropriate to your business.

13. BRIXSO's role

BRIXSO is responsible for determining how buyer information is collected and used within the BRIXSO service and for the purposes described in the BRIXSO Privacy Notice. Where BRIXSO shares buyer information with an agent and the agent subsequently determines its own purposes and means of processing that information, the agent may act as an independent data controller for that subsequent processing. The parties will act in accordance with applicable data protection law.

14. Agent security and access

You must take reasonable steps to ensure that people within your organisation who have access to BRIXSO buyer information understand their responsibilities regarding confidentiality and data protection. You should not provide access to BRIXSO buyer information to individuals who do not need it for legitimate business purposes.

15. Breach of these terms

BRIXSO may suspend or terminate an agent's participation in the BRIXSO service where the agent:

  • seriously or repeatedly breaches these terms;
  • misuses buyer information;
  • sells or improperly shares buyer information;
  • fails to take reasonable security measures; or
  • engages in conduct that creates an unacceptable risk to buyers or BRIXSO.

Termination of participation does not remove any legal obligations relating to personal information already received.

16. Changes to these terms

BRIXSO may update these terms from time to time where reasonably necessary to reflect changes to the BRIXSO service, applicable law, regulatory requirements or data protection practices. Agents will be informed of material changes where appropriate.
